
Nicola qualified in 2003 and joined Birketts in 2024. She is a Partner in our Real Estate Division and part of the Residential Development Team in the East Anglia region.
Nicola specialises in development sector projects, particularly housebuilder work. She has over 20 years’ of experience advising landowners and housebuilders in respect of site acquisitions and disposals to deliver both residential and commercial development. She regularly advises on complex conditional contracts, options, promotions and development agreements, as well as joint venture consortium arrangements (contractual, corporate and LLP structures). Nicola provides commercial and pragmatic advice to Housebuilders to ensure contracts are structured to achieve swift site delivery from acquisition to plot disposal. Nicola has extensive experience in tackling development constraints and drafting bespoke documents in accordance with emerging legislation, such as BNG, Nutrient Neutrality and Habitat Management Agreements.
Nicola also has a wealth of experience of publicly funded development projects for local authorities and education institutions to assist clients in creating new facilities and buildings for community benefit. This includes advising on LEP funding and clawback agreements, surplus land disposals with overage and mitigation site acquisitions.
Recent work highlights
Acting on behalf of a regional SME developer acquiring a serviced development plot on outline planning consent as part of a wider development site for delivery of approximately 2000 dwellings across 3 phases. Negotiating infrastructure delivery obligations together with step in and pre-emption rights, compound licence and procuring professional team reliance package.
Acting on behalf of a consortium of landowners in connection with an option agreement in favour of a national plc housebuilder, including negotiation of third party off-site agreements required to facilitate development.
