On 21 July 2021, the Government published an Easy Read version of How to Rent: the checklist for renting in England (How to Rent guide).
A landlord under an assured shorthold tenancy (AST) will be prevented from serving a notice seeking possession under section 21 of the Housing Act 1988 unless it has complied with certain legal requirements and provided the tenant with prescribed information. It is required to provide a copy of the ‘current version’ of the How to Rent guide (regulation 3, Assured Shorthold Tenancy Notices and Prescribed Requirements (England) Regulations (SI 2015/1646)) and this is usually and sensibly done at the outset of the tenancy. However, both documents (the current version and now the ‘easy read version’ are entitled: “How to rent: the checklist for renting in England”.
So, which one is a landlord to serve? Unfortunately, no guidance has yet been given as to when it might be appropriate to provide the new Easy Read version, and whether it can be given instead of the longer version or whether the longer version should be provided as well. Until such time as further guidance is issued, our recommendation would be for a Landlord to serve the current long version (non easy read) of the Guide.
